Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CyberBrief AI, operated by SmartData Technologies Limited, a company registered in Bangladesh (“SmartData”, “we”, “us”, or “our”).

By accessing or using CyberBrief AI at cyberbrief.online (the “Platform”), you agree to be bound by these Terms.

If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

CyberBrief AI provides cybersecurity intelligence, compliance tracking, and threat monitoring services designed for financial institutions regulated by Bangladesh Bank, BTRC, BFIU, and other Bangladesh regulatory authorities.

The Platform includes:

• Real-time CVE and vulnerability tracking
• Bangladesh Bank ICT compliance monitoring
• Threat intelligence and dark web monitoring
• Security incident response support
• Training and awareness tools
• Bangladesh Bank examination preparation and evidence generation

3.1 Eligibility. You must be at least 18 years old and authorised to act on behalf of your organisation to create an account. CyberBrief AI is intended for business use only.

3.2 Account security. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorised access at info@smartdataltd.com

3.3 Accurate information. You must provide accurate and complete information when creating your account and keep it updated.

3.4 Work email requirement. Registration requires a work email address. Personal email addresses (gmail, yahoo, hotmail, outlook) are not accepted.

4.1 Plans. CyberBrief AI is offered on monthly subscription plans:

• Starter: ৳15,000/month
• Professional: ৳35,000/month
• Enterprise: ৳75,000+/month
• MSSP: ৳35,000 per managed client/month

All prices exclude 15% VAT applicable in Bangladesh.

4.2 Free trial. New accounts receive a 14-day free trial with full Professional plan access. No credit card or payment is required to start a trial. After 14 days, the account is downgraded unless a paid plan is selected.

4.3 Billing.

• Invoices are issued on the 1st of each month for the current month
• Payment is due within 7 days of invoice
• Accepted payment methods: bKash Business (01903903903), cheque payable to SmartData Technologies Limited
• Annual plans receive 10% discount and are non-refundable after 30 days

4.4 Late payment. If payment is not received within 7 days of the invoice date:

• A payment reminder is sent
• Access may be suspended after 14 days
• Access is terminated after 30 days of non-payment

4.5 Taxes. You are responsible for all applicable taxes including 15% VAT. Provide your BIN number for VAT-registered invoicing.

You agree to use CyberBrief AI only for lawful purposes related to your organisation's cybersecurity programme.

5.1 Permitted use.

• Monitoring your organisation's security posture
• Tracking compliance with Bangladesh Bank ICT requirements
• Generating evidence for regulatory examinations
• Training your security team
• Managing security incidents and vulnerabilities

5.2 Prohibited use. You must not:

• Use the Platform to conduct unauthorised security testing against systems you do not own or have written permission to test
• Share your account credentials with users outside your organisation
• Attempt to access other organisations' data on the Platform
• Reverse engineer, decompile, or copy any part of the Platform
• Use the Platform to store or process information in violation of applicable law
• Resell or sublicense the Platform without written consent from SmartData (except under an MSSP agreement)
• Use automated tools to scrape or extract data from the Platform

5.3 Security scanning authorisation. The CyberBrief AI discovery agent and import tools are provided for use only against systems your organisation owns or has written authorisation to scan. Unauthorised scanning of third-party systems using CyberBrief AI tools is prohibited and may violate Bangladesh law including the Digital Security Act.

6.1 Our IP. CyberBrief AI, its code, features, content, and design are owned by SmartData Technologies Limited. These Terms do not grant you any ownership rights.

6.2 Your data. You retain all rights to data you upload or input into the Platform. By using the Platform, you grant SmartData a limited licence to process your data solely to provide the service.

6.3 Feedback. If you provide feedback or suggestions about the Platform, we may use this feedback without any obligation to you.

6.4 Threat intelligence. Threat intelligence data displayed on the Platform is sourced from public and licensed third-party feeds. This data is provided for your organisation's internal use only and must not be redistributed.

7.1 Our obligations. We treat your security data, compliance assessments, and findings as confidential. We will not disclose this information to third parties except as described in our Privacy Policy or as required by law.

7.2 Your obligations. The Platform may display information about emerging threats, active exploits, and vulnerabilities. You agree to handle this information responsibly and not to disclose it in ways that could enable harm.

8.1 Uptime. We aim to maintain Platform availability of 99% measured monthly, excluding scheduled maintenance.

8.2 Scheduled maintenance. Scheduled maintenance is performed during Bangladesh weekend hours (Friday 22:00 – Saturday 06:00 Dhaka time). We will provide 48 hours advance notice for maintenance exceeding 2 hours.

8.3 No guarantee. The Platform is provided “as is”. We do not guarantee that:

• The Platform will be error-free or uninterrupted
• Threat intelligence data will be complete or current
• Bangladesh Bank examination preparation will result in any specific examination outcome

9.1 Security outcomes. CyberBrief AI is a compliance tracking and threat intelligence tool. Use of the Platform does not guarantee:

• A specific outcome in any Bangladesh Bank ICT examination
• Protection against cybersecurity incidents
• Compliance with all applicable laws and regulations

You remain solely responsible for your organisation's cybersecurity posture and regulatory compliance.

9.2 Threat intelligence accuracy. Threat intelligence data is sourced from public and third-party feeds and may not be complete, accurate, or current. CyberBrief AI risk scores and compliance assessments are estimates based on available data and should not be the sole basis for security decisions.

9.3 Limitation of liability. To the maximum extent permitted by applicable law, SmartData Technologies Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the 3 months preceding the claim.

You agree to indemnify and hold harmless SmartData Technologies Limited and its employees from any claims, damages, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any applicable law
• Your organisation's security incidents

11.1 By you. You may cancel your subscription at any time from Settings → Billing → Cancel subscription. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

11.2 By us. We may suspend or terminate your access immediately if:

• You violate these Terms
• You fail to pay invoices after 30 days
• We are required to do so by law
• We reasonably believe your use poses a security risk

11.3 Effect of termination. On termination:

• Your access to the Platform ends
• Your data is retained for 12 months then deleted (or 36 months for compliance records)
• You may request an export of your data within 30 days of termination

These Terms are governed by the laws of Bangladesh.

Any disputes arising from these Terms or your use of CyberBrief AI shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.

We encourage you to contact us at info@smartdataltd.com to resolve any dispute before initiating legal proceedings.

We may update these Terms from time to time. When we make material changes:

• We will update the “Last updated” date at the top of this page
• We will notify registered users by email at least 14 days before changes take effect
• Continued use after the effective date constitutes acceptance

If you do not agree to updated Terms, you may cancel your subscription before the effective date.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SmartData Technologies Limited regarding the Platform.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
